PREAMBLE: The Town of Hopkinton is appreciative for the gift of the Kimball Cabins and the environment in which they are set. The cabins and surrounding environment entitle all residents and their visitors to enjoy a scenic setting, flora and fauna observation, and recreational opportunities. In order to maintain the property in all of its originality, and to preserve the delicate balance of nature, the Board of Selectmen, Recreation Department, and Conservation Commission request that the following rules be adhered to:
AGREEMENT & RULES:
1. Any person or organization that wishes to use the Kimball Cabins is required to sign the enclosed agreement. The agreement outlines responsibilities, procedures, and standards for use of the facility. It also establishes a fee system for use of the Cabins, if applicable. Exclusive use of the Cabins does not provide for exclusive use of the Kimball Pond. The pond area and grounds shall remain open for public use.
2. All non-profit organizations shall be exempt from the established user fee, but will be subject to a returnable $100 security deposit. All resident private use will require a $25 fee plus a returnable security deposit of $100. All non-resident use will require a $45 fee plus a returnable security deposit of $100.
3. The user shall be responsible for set-up, breakdown, and clean up of the facility. Should the facility be left in an unacceptable condition, the user will forfeit the security deposit to cover the costs of janitorial or repair services. If any damage exceeds that of the security deposit, the user will be required to pay the additional expense. All trash carry out is the sole responsibility of the user
4. Chaperones are required for groups whose participants are below 18 years of age. All chaperones must be 21 years of age or older and are subject to the approval of the Recreation Director. The number of chaperones required will be vested solely with the Recreation Director who will exercise his judgment and experience in determination of the required number.
5. Smoking is not permitted within the Cabins. The user must ensure a receptacle is available for any outdoor smoking and for take-away of any receptacle.
6. If wood is burnt in the fireplace, the user is responsible for insuring that the fire is completely and totally extinguished.
7. No alcoholic beverages are permitted in the Cabins or within the grounds.
8. The Board of Selectmen requests that all safety standards be maintained (snow removal from steps in winter, turning off of all lights both in the cabin and by the pond). All doors should be secured before leaving.
9. Users are responsible for arrangement of key pick-up with the Recreation Director, Tel. No. 746 - 2915 or 746 -3170. Security Deposits will not be returned without return of key(s).
10. The Board of Selectmen reserves the right to revoke use and rental privileges and security deposit at anytime, should any of the above stipulations not be met.
As concerns the use of premises known as the Kimball Cabins, located off Main Street, Hopkinton, NH. The undersigned agrees to indemnify and hold harmless the town of Hopkinton from any and all loss, cost (including attorney’s fees), damages, expense and liability in connection with claims for property damage, bodily injury or death of any person which may arise out of the use of the town facility known as “Kimball Cabins.”

The deposit will be returned to the User within 7 days of the last date listed above for the activity requested, provided that the user has not violated the rules set forth in the “Agreement of Rules” section, and has returned the keys to the facility.
I have read and understand the terms of the Agreement. I understand that failure to comply with any rule of the agreement will result in forfeiture of the Security Deposit.
